I've written and sold several articles over the years. I've always retained the rights to them. Periodically I do a search to see where they may have turned up on the web. It's amazed me how they have proliferated to a considerable number of sites. Up until now the sites they have appeared on have always linked back to the original site that published them which I have no problem with. Last night however I discovered a site that has posted one of my articles verbatim without my permission and without even my name on it. I have a pretty good idea what I'm going to do about this but I'm interested in what you guys would do in this situation. http://home.comcast.net/~rnick9/koolsmiley.gif

im really concerned about alot of my photography blog stuff being used for websites, so I feel you on that. fortunately for me, buzznet has a tracking device so I can see where every hit comes from.

hmm, this is quite an interesting problem, you retain the rights so...its important your name is attached each time its reposted...
I think JF would have some input if he comes through here soon enough.
I would think a simple email informing them to remove the article, or provide the link would be the first step either way

You could always send them an email pretending to be an attorney from the law firm Duey, Cheatham and Howe.
It depends on the type of site it is. I mean, is it a hobby/personal site or an advertising/subscription based site? In other words, how certain are you that they "know better."
I'd start with explaining to them exactly what you have here. Remind them what "Fair Use" means.
Of course you could always get a cease and desist, but I'd try going the polite route first. Hell, I've seen people on this forum post FULL articles with no citations, no links, nothin'. That's not "fair use", but you know. Context.
Good point EC, I'm not really interested in making them take it down. I will write them and ask them to place my name on it since it is my work. It's posted as an informational peice. The site features 3D art fantasy wallpapers and you guys should check it out as there is some incredible stuff on there. Beware that a lot of it is NSFW. if you don't mind that they posted it (so long as they give you credit, as they should!) then a brief, polite email is the way I would go. They obviously value the information you provided... it is only a small gestre for them to add the credit/byline.
