Was just reading another thread that mentions this, thought it warranted a thread of it's own.

Living in New Zealand we get a few overseas clients. Can an email contract be seen as binding?

What if in the contract itself, it says something along the lines of "an email response stating contract agreed and approved by so-and-so on this date is binding".

I'm going to ask my lawyer student friend this too and post her answer.

I don't know how binding it is, but I do it a lot. By typing their name and in parentheses afterwards they have to put (electronic signature). I noticed its okay to do with the student loan people, so I figure its good enough for me. If its a client that I don't entirely trust, then I make sure to get a hard copy either mailed or faxed.

We still use faxes for long distance.
Makes it harder for the less scrupulous to change the wording.
Sometimes followed up by FedEx depending on the dollar amount

I send a PDF contract, and they are just asked to send me "yes I agree to the terms of your contract."

So far I have not had a problem with it.

Yes, what you say in email is legal and binding.

Good Point! It has to be binding.....I know I am bound!
