Hi everyone,
First time i've been in this situation,
I had a freelance illustrator design me a logo for a company "precious moments massage" and they designed the above for me. I have since put together website and online store and now i've found this....

wow, that's a pretty blatant ripoff. are you going to take legal action?

That is pretty incredible to try and pull that off. Good thing you did some research. Not sure what you do in that situation.

I would contact the illustrator and demand a full refund (including any expenses that you incurred in registering the logo, if applicable), then hire someone else to design a new logo.
If they refuse, you will probably need to take legal action.
I am sorry that you had to deal with this.

in the very least you should be able to get a full refund.
maybe tell the original company that this guy is trying to make money off their logo, so it's up to them if they want to pursue the matter further? i'd like to see this person take a hit.

On another note, am I the only one that thinks the logo looks a bit, um, "dirty"?

wow what a rip off.... you can clearly see the IAIM letters in the logo when you know what it was initially designed for... unbelieveable! just goes to show you can't get away with ripping off someone elses designs these days!
do what the wise librarian says... get your money back and go with someone else. if they won't pay you, you've got a real strong court case there!

yes, Plus the client really likes it. Is there no way of altering the design so that it can be used??
Do what the others are saying but the first thing to do is take it off any of your stuff before the IA of IM sees it and you find yourself in legal trouble from their end.

it's clearly someone else's logo... I can't see a way that it can be used, even if it were altered slightly. It's a myth that changing a few things would make it a "new" design.

Yes i've removed all the branding when I found the other logo...
The client likes this logo so its of real disappointment to them.

Nope, looks like something that would be appropriate for "Pedo Files", MD's Latin American archival service. Or, it would be right at home next to the phrase "Our Little Secret". Creepy.
Not only is it a blatant rip-off, its not done very well either. The paths are a bit rough and clumsy, either it was done in a big hurry, or the illustrator needs to work on their command of the pen tool.

WOW! Yep - I'd demand a refund & sue if you don't get it. You just need to blow your client away with a new logo & then they will forget how they liked this one. And why they liked it, I don't know. I also think it looks really creepy. It could also look like a mother/child logo. But it definitely does not say massage to me. I can see how the original designer designed it to be the company's initials.
