So ok I designed cd fro a client. I shot the photography for it and layed it out and manipulated my own fotos.
The client is wanting the front cover of the album hi res pic.
There was no contract I am learning "trial by fire" but here is the deal what i feel and tell me and please give me some advice if you would thanks.
I was paid for time to lay it out design it, call the printers for prices, and take the pictures for the cd cover inside and band shots. I do not feel that they paid nearly enough to own/have the hi res pics of the cover.
any great advice from the pros would be awesome thanks so much

You answered you own question. Don't let yourself be ripped off if that is how you feel about it. Give them a price and see how it goes.

There are no lawyers on this forum. Without any form of contract whatsoever, the waters are extremely muddy, because the client will expect to be given everything, because they have paid an agreed amount (clients rarely understand copyright unless it is spelt out to them in a contract). Technically you own copyright of your designs and photography and can charge (please set out a contract stipulating what exactly is being purchased) for the client to have full copyright or charge them a usage fee per time they use your photograph. The client may be under the impression that the fee agreed in the beginning included the copyright to the photography. This is where the water gets muddy because it was your responsibility to make sure they understood that it was not included in the price that was agreed for the job. I am not a lawyer. You need one by the sounds of things.

If I were a client and I asked for a CD to be designed, I would not under assumption that I was getting the high res photo too. The photo belongs to the photographer. That's just me.

I'm not a lawyer either.

excellent I jsut am wanting some language to give to them like i said I am learning about contracts and such thanks for the help....

i agree w/ buda and frankster here.....while its a decision YOU need to make, the lack of a contract does muddy the communication lines a bit in respect to what your deliverables were exactly, and how copyright would get transferred. Its tough because you didn't use a contract (yep lesson learned, we've all been there at least once).

DO you see yourself getting a lot more work from them? OR is this a oneshot deal? I would try to kindly explain why you would like more compensation for the high res images. Did you charge time for the photo shoot? IF NO, then you can make it seem like you were giving them a gift, and that it is financially unfair for them to ask for the images w/out proper compensation. Doubt they know much about design contracts, so you COULD have the upperhand if you explain it right...

yes i charged a certain price for the design time
and another for the time to go shoot the pics for the cd

usually whenever I do a custom photo shoot, its a set price no matter what and they get the images in watever format they want them in, but again, it doesn't seem like that was discussed and that you didn't explain that to them. you might want to consider hitting a middle ground, like unlimited rights usage for a certain payment.
