Lets say your photo is at 300 dpi, 4x6"
and you layout is 5x7"
Can you re-sample the image and still get away with the new dimensions at 300dpi? so in a way I am up-sampling.
What is the extend of up-sampling any guidelines?

4x6 doesn't scale to 5x7 without a little cropping.
If in doubt, print it out.

thanks, i heard you can go up 20% and resample at 300 dpi without getting too grainy.

The only rule with upsampling is, as PD said:
If in doubt, print it out.
Some images you can upsample quite substantially, and they'll look fine. Others will look terrible with even slight upsampling. It all depends on the exact image content, and that is unique to every picture.

thanks printdriver, so if i print it out on my inkject and it looks good does it mean it will look good under press?

No. Get a proof.
Your inkjet on fine quality printout on good paper will tell you immediately if you need to do something else. It is not always a good indicator of what will come off a press.
