Yes, the picture can be created easily by a guru in photoshop or any other graphic art program that deals with layers and transparencies.
p.s. Don't frown, just enjoy live for its great variety.

this was done in photoshop however.... the same affect could be produced quicker in illustrator. boom!

Thanks for the helpful comment, CkretAjint. Appreciate that. Tried it and is almost there.
The thing is... how do I make it swirl or wavy-like?
As you can see, in both http://www.shutterstock.com/pic.mhtml?id=3245628, and http://www.shutterstock.com/pic.mhtml?id=2898449, the wave is smooth and not straight, as stated in the tutorial.

you can free hand it (simplest) or using multiple techniques with the pen tool to bend the waves.

I would guess that they are made in a 3D app, n.u.r.b.s., thats how I would go about it anyway.
You could always ask the artist: Yurok Aleksandrovich, talented kid.
