  • What to tell client now?

    #1
I had a client pay a small deposit to get me started on her logo and web redesign. In the contract I made with her, I stated that I would do several logos first for her to choose from and make revisions as necessary. I would then redo her website.

6 logos later that she totally hates, she said to just go ahead on working on the website and to get back to the logos later. So I sent her 2 mockups of web templates to show her the layout abilities. She replies: I've seen those online, I wanted something unique, I want my money back. Ugh.

I don't have anything in the contract about refunds, just this (summary, copied and pasted)
    (TERMINATION:

Either party may terminate this Agreement by giving 30 days written notice to the other of such termination. In the event that Work is postponed or terminated at the request of the Client, Consultant shall have the right to bill pro rata for work completed through the date of that request, while reserving all rights under this Agreement. )

    blah, blah, blah....
So even though she did not choose any of the logos, do you think that the sentence about billing for work completed still applies? This is the first time I've had a yucky client...Thanks.

Yes, your contract says you can bill for work completed through the date of termination, so that includes all work, not just the work that the client wants to use. in fact my contract says if the contract is terminated by the client, they have to pay for the work i've done AND they have to return all my work and are not allowed to use any of it. This happened to me once too, it sucks. just be glad you had a decent contract in place. take this opportunity to revise your contract for next time, and put everything in there you wish were in there now.

Yeah, so just mark how many hours it took for the logos and 2 web site mock-ups. Then bill. Its within your right to ask because you spent time on this client, when that was time you could have spent working for someone else. It might not be a big bill, but you still need to charge something.

Did you send templates or something you made from scratch? If you actually sent templates i'd want my money back too.

ah, i just read more closely your original post, and i agree with ecsyle. If you sent templates that are elswhere online, then it's no wonder the client want's to cancel. if they expected original work and got a template, it will surely feel like a dishonest shady situation, and it's understandable they'd want to walk. i think if that's the case, the ethical thing to do is charge for whatever ORIGINAL logo work you did for them, and not bill for the web design, since you didn't deliver what was promised- original work.

I think you need to clarify about the templates. Where they mocked up templates you created or obtained elsewhere?

She pays for your hourly rate. And you take all the design copyrights.

Sounds like you need to take better briefs.
