  • Image rights

    #1
I have a client who wants an original illustration. She wants to put it on her website, brochures, tshirts, etc. She wants full rights to the image. What is a ballpark range for how much you sell an image and all it's rights for, or is this not advisable?

    Please help.
    Thanks,
    Jamie

You've been here a while now. I'm amazed you haven't noticed that we can't discuss pricing on the forum. There's a whole thread on the reason why somewhere (it's illegal). Morea will probably be along in a mo to point you to it.

Actually, what on earth is the protocol with such things, because surely there's nothing to stop members PMing pricing info. Do you have to delete threads where people have asked pricing info so that others don't find them and respond via PM, or is that not illegal in the same way that discussing in a thread is?

I may not have Morea's legendary librarian skills, but I do know that the thread in question is right here:

You'll have to be quick if you want to beat BudaSylar and her telekinetic chopsticks.

I don't need chopsticks. I slurp: a la Lady and the Tramp spaghetti style!

Though you are safe for the time being Hewligan I just had Subway. I must say, their new roast lamb sandwhich has really taken a place in my heart...or is that belly?

I realize we can't discuss pricing. I am looking more for a general direction. Have any of you ever encountered this before? Is there a reason why I should not sell her all the rights? Is it a common practice to hand over all the rights?

This is more what I am looking for, or links to resources addressing this issue.

                Thanks,
                Jamie

Sorry for hijacking your thread Jamie!

When I do commissioned artwork I hand over the rights for them too. Unless of course it's filled with characters I've designed and use in other things. In that case I guess they can use that image, but it's not just theirs because the ideas and characters come from elsewhere.

As of right now I'm planning on doing it. I just want to be sure and be aware of any ramifications that I could encounter by doing this...pretty sure missing subway and whatnot don't really factor in.

I charge typically 2-5 times my original usage rate. Depending on complexity of what the project is and the scope of usage. I also put in contract that the buyer cannot resell the copyright only reproduce the images for their own exclusive means. Or if they want a price break I "exclusively lease" the images for a period of time. This is a great way to keep the copyrights to the image and still have a happy customer.

This is different if you are creating a logo, of course.
