  • Apple's trademark infringement case

    #1
I thought this would be interesting, since we're constantly talking about copying someone else's logo in various crit threads.

    http://gizmodo.com/5932198/how-samsu...apple-ios-icon

Basically Apple is claiming that Samsung copied some of their iOS app icons and used it on their phones.

NOTE: This is not intended to be an Apple vs Google or Mac vs PC thread. I just thought it was worth posting because it's something that we in the graphic design industry come across every once in a while.

i see the similarities but those icons are very generic. no one besides apple can use a tilted phone as an icon to answer a call? quit being such an emo kid apple, you can't own everything.

I had a Nokia flip phone way before iPhones even existed that used extremely similar icons

They already know it. They're just suing all other phone & tablet makers over every single possible feature, in all countries simultaneously. Making it as big of a legal hassle as possible to hold down the competition. Usually it just gets dismissed. But sometimes they get lucky and for example Samsung can't import tablets into Australia for a few months. All the other companies are doing the exact same thing back at them. It's just a giant money throwing fight for the lawyers in the end, we really need patent reform.

I think i saw a graphic once showing a Samsung store (didn't know they had any) and it had icons all over the store and some were Apple icons. they don't even know which icons are theirs.

Honestly the icons and shape do resemble each other but I thought for years the answer/call button was a phone that would light up green (on some phones) and the end was a red color. very funny that it is the "old school" phone too.

Over the weekend my wife's grandmother asked me what to do with her phone when it froze when trying to take a photo...i said I wasn't sure, get an iPhone. She told me harshly she HAS an iPhone! I said, no it is a Samsung smartphone, I don't know what button does what. I was able to find the "Home" button and get it to at least display icons.

Overall the are similarities, but once you get to use it, they are different. *and confusing to me, an iPhone user)

I can't wait for the day that we either have to say "I had a round tree fruit with lunch" or risk the wrath of Apple

It is a little too close for comfort, though. It looks like whoever designed Samsung's icon believed in the "change XX% rule". Using a tilted phone is one thing, but these icons look almost exactly the same.

I hope the legal fees don't just end up costing us all more for our shiny toys.

I'm eying the long-awaited Samsung Galaxy Note 10 out this month:

but when does it end? didn't pay phones have a phone icon?

the two icons are very similar, but for something so generic and basic as a phone icon and an address book icon it seems like a pissing match that as Bob points out will most likely cost US more in the long run.

reading on some Tech blogs...more about the Apple/Samsung battle.

Apple told Samsung not to copy the Inertial Scrolling/Rubber Banding...but they went ahead and did it. Before going to court with Samsung, Apple (Jobs) talked with Samsung about licensing inertial scrolling as they (Apple) had a patent on it. Samsung decided not to license it and keep using it.

Part of me wonders if Apple's Multi-Cases against Samsung is done to show how much Samsung, being a builder of iPhone components went ahead and just copied Apple's style with the iPhone into theirPhones. So, perhaps the icons is another case to be able to say look, there are all these cases where Samsung copied us.

Maybe it was the color of the icons, the way the standard phone is cocked to the side, the rounded corners, the gradients...whereas some phone icons out there are not just like Apple's but different enough to not mimic.

I read on one site that Samsung's lawyers couldn't tell which tablet was the iPad and which was the Samsung Galaxy Tab by looking at them. Not looking good for guys trying to prove that Samsung isn't copying Apple's designs.

Here's an interesting update. A 200+ page Samsung document was just released showing comparisons that Samsung made between the iPhone and their phone. It lists all the features that the iPhone did better, and lists notes on what to change to make their features more like the ones on the iPhone.

"iPhone has End Call as a large button the entire width. Samsung model is small...make it large and full width"

                              oops.

I thought I paid between $75 - $140 for my portfolio (PZ) alone. with the "plastic" sheets

And based on your numbers is that around 20-25 pages in your portfolio?
